FDIC includes IOLTA in unlimited deposit insurance under Temporary Liquidity Guarantee Program
November 25, 2008 -
On Nov. 21 the FDIC clarified the Temporary Liquidity Guarantee Program to include Interest on Lawyer Trust Accounts. Consistent with its mission to ensure stability in the banking community, the FDIC has acted to protect client funds and assure continued funding for programs that provide legal aid to poor people when economic uncertainties make the need for legal guidance most critical. As a result of this action, an individual client’s funds deposited in IOLTA are fully insured regardless of the amount. More

State Bar conducts survey on mandatory Bar membership
November 25, 2008 -
The question of whether the State Bar of Wisconsin should be a mandatory or voluntary association dates back to 1956, when the Wisconsin Supreme Court made membership in the Bar a condition for the practice of law in Wisconsin. The mandatory membership rule was suspended in 1988 by order of a federal district court but was restored in 1992 by action of the Wisconsin Supreme Court. More

WisLAP volunteer attorneys headline ethics program on work-life balance, addiction, and mental health challenges affecting lawyers

The Wisconsin Lawyers Assistance Program (WisLAP) joins the U.W. Law School's Center on Impaired Driving and the Dane County Bar in presenting "The Ethics of Addiction, Mental Health, and Other Troubles Facing Attorneys" on Dec. 6. WisLAP is a State Bar member service that provides confidential assistance to lawyers, judges, law students, and their families in coping with alcoholism or other addictions, mental illness, or other problems related to or affecting the practice of law. Supreme Court agrees with BBE petition – reciprocity not always equal – new rule for lawyers not licensed to practice in Wisconsin coming soon

On Nov. 18, the Wisconsin Supreme Court adopted Board of Bar Examiners petition 08-07, which amends Supreme Court Rule (SCR) 40.05, relating to admitting lawyers upon proof of practice. The court expects the rule to be effective on Jan. 1, 2009 when SCR 20:5.5, pertaining to the occasional practice of law in Wisconsin by lawyers who are not licensed to practice here but are licensed in another state becomes effective. WisTAF and banks debate petition seeking comparable interest rates on IOLTA accounts at Wisconsin Supreme Court
November 19, 2008 -
On Nov. 18, the Wisconsin Supreme Court adopted in principle several amendments to SCR 20:1.15 relating to safekeeping property of trust accounts and fiduciary accounts. The changes relate to banks paying comparable interest on lawyer trust accounts. The court will study several issues before making its final ruling. The new rule will be effective July 1, 2009, which will give banks enough time to be in compliance with the new rule. More
